Terms & Conditions

1) General

These conditions shall apply to any contract made, quotation given, goods supplied, advice provided or service rendered by D.tec International Ltd (or any Division or employee thereof) to the exclusion of all other terms and conditions save such variation and additions as are agreed by D.tec International Ltd in writing.

2) Descriptions

The descriptions and illustrations contained in brochures, price lists, Website, leaflets or other descriptive matter shall not form part of the contract and no report, representation or statement made by any servant, employee or agent of D.tec International Ltd shall be binding on D.tec International Ltd.

3) Completion

D.tec International Ltd will use its best endeavours to complete its contractual obligations within the period stated in the contact (if any) or in a reasonable time but shall be under no liability in damages or otherwise for failure to do so from any cause whatsoever however arising. In no circumstances shall delay be a ground for cancellation of the contract by the Customer.

4) Post, Packing & Insurance

Unless otherwise expressly stated in writing in the contract packing is not included in the contract price and will be charged extra by D.tec International Ltd. D.tec International Ltd does not give any warranty as to fitness of any packing for storage purposes.

5) Transit

Claims for damage in transit or shortage in delivery of the goods will only be considered if the carriers rules are not met and D.tec International Ltd receive written notification of such damage within three days of delivery or in the event of loss of goods in transit within 21 days of the date of consignment. When goods are accepted from couriers without being checked, the delivery book must be signed “not examined”. Force Majeure will apply for export orders.

6) Price

Any prices quoted by D.tec International Ltd are ex works and based on the cost of materials and labour and import duties and expenses and the cost of conforming to statutory obligations ruling at the date of the contract and if between the said date and the date of delivery of the goods or the date of performance of the services variations occur in the aforesaid costs e.g. VAT/transport the contract price shall be amended to provide for such variations and any additional sum payable to D.tec International Ltd by the Customer in respect of the same shall be paid in cash sterling. The Customer shall pay all transport, insurance, and (where applicable) any taxes, licence fees, customs, import and export duties and charges. All orders will be subject to incoterms.

7) Inspection - Acceptance

Any goods supplied by D.tec International Ltd under the contract shall be released in accordance with the relevant requirements of any statutory inspection organisation and in addition such of the goods as are manufactured by Securetec shall be inspected and released by Securetec under its own system of inspection as approved by any appropriate statutory authority and such inspection and release shall constitute acceptance of the goods.

8) Warranty

i) D.tec International Ltd hereby warrants to replace any DrugWipe(s) supplied which is proved by the manufacturer upon return and inspection to have been defective at the time of delivery in material or workmanship, provided the DrugWipe(s) are returned to D.tec International Ltd within 18 months from the date of delivery and 1 week from finding the defect.

ii) In the case of any product not manufactured by Securetec and supplied by D.tec International Ltd the goods will be guaranteed or under warranty from the makers, therefore D.tec International Ltd will return to the manufacturer for inspection, report & resolution.

iii) Where D.tec International Ltd contracts to perform work or services D.tec International Ltd shall rectify any error or omission therein which shall have been notified in writing to D.tec International Ltd within three calendar months from the date of completion thereof and which shall have been due to the neglect or default of D.tec International Ltd provided that if it is due to a defective device, it is returned to D.tec International Ltd direct carriage paid within three calendar months from the date of completion of said work or services.

iv) Except as set out in (i), (ii) and (iii) above D.tec International Ltd will not be liable in contract or in tort or otherwise for any loss injury or damage either direct or indirect or consequential sustained by reason of any goods supplied or services performed by D.tec International Ltd or of anything done or omitted by reason of the negligence of any person or otherwise and the warranties set out in (i), (ii) and (iii) above will be accepted in place of any condition or warranty expressed or implied by law or otherwise.

v) The Customer will indemnify D.tec International Ltd against all claims against D.tec International Ltd by any of the Customer’s employees, liability for which would have been excluded by this condition if the claim had been made against D.tec International Ltd by the Customer.

vi) In the event of a claim being made by the Customer or by any of the Customer’s employees against any of D.tec International Ltd employees, liability for which would have been excluded by this condition if the claim had been brought by the Customer against D.tec International Ltd. D.tec International Ltd will be entitled to indemnify their employee against such claim and the Customer will indemnify D.tec International Ltd in respect of any sum paid by D.tec International Ltd as such indemnity.

9) Cancellation and Return of Goods

i) D.tec International Ltd offer a 7 day cancellation and return policy

ii) You must notify D.tec International Ltd in writing via post, fax or email.

iii) Goods received by you must not be opened or tampered with and returned immediately to D.tec International Ltd at your own cost and risk. Please note that, once opened and or used, products cannot be returned to us unless the product is faulty.

iv) Once you have notified us that you are cancelling your contract, any sum debited to us from your credit or debit card will be re-credited to your account as soon as possible once the goods have been received back in the condition they were received by you.

10) Patents

If any goods to be supplied by D.tec International Ltd are to be in accordance with the Customer’s specifications or instructions the Customer will indemnify D.tec International ltd against all damages, penalties, costs and expenses to which D.tec International Ltd may become liable or which D.tec International Ltd may incur through complying with any such specifications or instructions, involving an infringement of Patent, Registered Design, or Trade Mark.

11) Legal Interpretation

The contract will be deemed to be made in England and shall be governed and construed for all purposes and in all respects in accordance with English Law.
